Terms and Conditions of Sale
Version 1.0 — 25 September 2026
These terms were written by PUTCH and are being reviewed by our legal counsel; the version in force is the one displayed here.
Article 1 — Seller
PUTCH, represented by Pierre-Emmanuel Saurais, Rue du Progrès 18, 2300 La Chaux-de-Fonds, Switzerland. Contact: hello@putch.ch. The legal form and the Swiss business identification number (UID) are given in the legal notice.
Article 2 — Subject
PUTCH designs and has made-to-measure garments manufactured from the customer’s measurements, obtained by declaration or by body scan (PUTCH Scan app, web or iOS, or a scanning provider). These terms govern every order placed on putch.ch or in the app. They are accepted when the account is created and apply to each order; the applicable version is the one in force on the day of the order.
Article 3 — Account and accuracy of measurements
- A customer account is required to order. The customer guarantees that the account information is accurate and keeps the login details confidential.
- The customer is responsible for the measurements they declare or obtain by scan: they are the basis for manufacturing. A garment that matches the measurements provided is deemed to conform to the order.
- PUTCH offers a verification of measurements before production: automatic consistency checks, a review by our team and, on request, a discussion with the customer when a value looks unusual. This verification is an aid; it does not transfer responsibility for the measurements to PUTCH.
Article 4 — Orders and prices
- Prices are shown in Swiss francs (CHF), including VAT where applicable.
- Delivery costs are shown before payment, in the order summary.
- The order becomes binding when payment is confirmed. PUTCH confirms it by e-mail.
- PUTCH may refuse or suspend an order in case of clearly inconsistent measurements, unavailable material or suspected fraud; the customer is informed and refunded where applicable.
Article 5 — Payment
Payment is made online through our provider Stripe, by card or TWINT. PUTCH keeps no card data: it is entered and processed directly by Stripe. An order goes into production only once payment is confirmed.
Article 6 — Production and delivery times
- Production starts within 3 working days of the order being validated (payment confirmed and measurements verified).
- An estimated delivery date is given at order time and again at dispatch. Lead times are indicative: they depend on production, the carrier and the destination and are not a firm guarantee.
- In the event of a significant delay, PUTCH informs the customer. A delay does not give rise to compensation, except in case of gross negligence by PUTCH.
Article 7 — Right of withdrawal
PUTCH garments are made to the customer’s specifications (their measurements). They are therefore not subject to a right of withdrawal. For consumers in the European Union, this is the exception set out in Article 16(c) of Directive 2011/83/EU (goods made to the consumer’s specifications or clearly personalised). Under Swiss law, there is no statutory right of withdrawal for distance sales.
As long as production has not started (Article 6), the customer may ask to cancel the order at hello@putch.ch; it is then refunded in full.
Article 8 — Statutory warranty for defects
- PUTCH warrants its garments against defects for two years from delivery (Art. 197 et seq. of the Swiss Code of Obligations). A garment that does not match the measurements provided by the customer is considered defective.
- Procedure: the customer reports the defect as soon as possible after noticing it, by e-mail to hello@putch.ch, with a description and photos. PUTCH explains how to return the item; if the defect is confirmed, return costs are borne by PUTCH.
- Depending on the defect, PUTCH repairs, alters, remakes the garment or refunds, within the limits set by law. Normal wear, care not in line with the instructions or alteration by a third party are not covered.
Article 9 — Alterations
If the difference between the delivered garment and the measurements provided is due to PUTCH (manufacturing or pattern), one alteration is offered free of charge. If the difference is due to inaccurate measurements provided by the customer, PUTCH offers an alteration or a new garment on quotation.
Article 10 — Putch Coins and discount codes
- Putch Coins: loyalty and referral benefits granted by PUTCH. They have no monetary value, cannot be converted into cash or transferred, and can only be used on putch.ch or in the app, according to the rules of the programme in force.
- Discount codes: one code per order; codes cannot be combined with each other or with Putch Coins unless stated otherwise. Their validity period and conditions (minimum amount, eligible products) are given with the code.
- PUTCH may withdraw a benefit or cancel a code in case of abusive or fraudulent use.
Article 11 — Intellectual property
The PUTCH brand, the website, the app, the patterns, the pattern-making method and the content (text, images, demonstration 3D models) belong to PUTCH or its partners. The customer acquires ownership of the delivered garment but no rights over the patterns or the method used to make it. The customer’s measurements and scans remain their personal data (Article 12).
Article 12 — Personal data
The processing of customer data (account, orders, measurements and body scans) is described in our privacy policy, which forms part of the contractual information.
Article 13 — Governing law and jurisdiction
These terms and every order are governed by Swiss law. The place of jurisdiction is La Chaux-de-Fonds (Switzerland), subject to the mandatory consumer forum: a consumer may sue or be sued before the courts of their place of residence where the law so provides.
Article 14 — Final provisions
- If a clause is void, the others remain applicable.
- PUTCH may amend these terms; the version applicable to an order is the one in force on the day of the order. Each version carries a number and a date.
- In case of discrepancy between language versions, the French version prevails.
